Who must prepare a risk assessment?
Employers are required by the Occupational Health and Safety Act and the DGUV 1 regulation to ensure the safety and health of their employees at work. Risk assessment is the most important tool.

Who can do a risk assessment?
Ensuring that risk assessments are carried out is the responsibility of the employer.
According to the Ordinance on Industrial Safety and Health, risk assessments may only be performed by qualified personnel (specialists in industrial safety or equivalent qualification).
According to § 13, Subsection 2 of the ArbSchG, the employer may nominate reliable and competent persons in writing, but the legal responsibility remains with the employer.
